RENTAL REGULATIONS
§ 1
The parties to the contract and the subject of the activity
• The initiative of the "Golden Dust" brand, giving the possibility to borrow clothes and accessories, is run by Karolina Kajca, running a business under the name "Golden Dust Karolina Kajca" based in Wschowa (67-400) at ul. Nowy Rynek 2, NIP: 497-005-91-48, also referred to as "the Lessor", the other party to the contract, making the loan through the Lessor is referred to below as the "Taking in Use" Regulations - jointly referred to as the "Parties". Correspondence with the Lessor may be done via email at golden.dust.karolina.kajca@gmail.com, telephone number: 503093603, face page Karolina Kajca or Golden Dust and at the address of correspondence: Karolina Kajca ul. Nowy Rynek 2, 67-400 Wschowa.
• These Regulations may be amended by the Lessor in the event of a change in the scope of business or the scope of services provided as part of the Golden Dust initiative and their prices, changes to the Lessor's data or non-compliance of the Regulations with the law. The change of the regulations may not deprive or limit the User's rights acquired under the previous wording of the Regulations. The linked pages are the content of the current version of these Regulations, in force at the time of placing the order.
• The purpose of the "Golden Dust" activity is to provide services consisting in free or paid rental of clothes and accessories, hereinafter referred to as "Goods" or "Lending Object".
• The product loaned through the Lessor is new or used. The landlord is obliged to deliver the ordered items without defects.
• Each Da-tax is labeled with the name describing the product.
§ 2
The terms of the contract
• Conclusion of a rental agreement means that the Recipient accepts the use of the provisions of these Regulations.
• A rental agreement is considered to have been made at the time of signing the "Loan Agreement" by both parties together with specifying the purpose and time of the rental together with a detailed specification of all the goods.
• The amount of the rental fee is based on the "Price List"
• The contract is concluded in Polish
§ 3
Technical condition
• The Lessor provides for using the goods in undamaged condition by using the Buyer in Use with his own signature.
• The Lessor, after receiving the Goods from the rental on the day specified in the word contract or the Rental Agreement, undertakes to check their technical condition not later than within 1 business day from the date of returning the product.
• The recipient is obliged to return it in a clean and undamaged condition.
§ 4
The taker's obligations to use
• Taking to Use agrees to use the Lending Object in accordance with its purpose and at the same time bears full responsibility for any events resulting from its improper use and any damage.
• The Taking User undertakes to use the Lending Object in accordance with the purpose set out in 1 of the Rental Agreement.
• Taking to Use is not responsible for the possible failure to place the loaned goods in the media, and at the same time their description in the text.
§ 5
Rental period and rules for calculating the rental fee
• The Lending Item is issued to the Buyer in Use on the day of signing the "Loan Agreement".
• The lending object is returned to the Lessor within the deadline specified under the word contract or contained in the "Loan Agreement".
• The amount of rental fees is set out in the Price List in § 7.
• Fees for borrowing the Subject of Lending are counted for the full rental period and collected from the bottom based on the issued invoice.
• The value of the invoice is determined on the day of the rental return.
• I am receiving an invoice for using the item borrowed at the latest within 7 business days from the date of returning the goods.
• The payment date for the loan is determined by the invoice.
• In the event of failure to meet the deadline for the Subject of the Lending, the Taking Consumer will be charged for the borrowed items according to the value specified in § 6, regardless of whether the loan was free or paid.
• The Lessor reserves the right to collect from using a deposit equivalent to 70% of the value of borrowed items.
• In the event of failure to meet the deadline for returning items that were needed for other projects during the retention period, the Takeor in Use shall bear the costs of canceled sessions.
• In the event of failure to meet the deadline for handing over items by the Lending Item, and creating problems in this matter, the Lessor may

Contractual penalties
• For the damage resulting from improper use of the loaned goods, the Billing for Use is to be borne, it also covers all costs related to the repair of the Lending Item.
• The landlord reserves the right to refuse to accept the goods when the damage is so severe that its repair becomes unprofitable. In this case, the user of the Use agrees to pay the entire value of the Good, according to prices that do not include discounts at the Golden Dust store (www.golden-dust.com).
• In the event of exceeding the deadline for returning the Goods, the Lessor reserves the right to charge a penalty of 70% of the price of the borrowed product at prices not including discounts in the Golden Dust store (www.golden-dust.com), clothes and products not available on the store's website, the Lessor reserves the right to charge a penalty of PLN 100 for the item, regardless of the time delay in delivery.
• The Lessor reserves the right to charge a fine of 70% of the value of the item if it has been used contrary to the purpose of the Rental Agreement.
§ 7
Price list and billing
• An invoice (VAT-exempt taxpayer) is issued for each loan, which will be sent to the Buyer in Use by post or in electronic form.
• Rental prices are determined on the basis of the following categories:
• PLN 0. INCLUDES: non-commercial loans for photo sessions in the Internet and print press: photo sessions bearing the signature of the author of the product and determined on the basis of the agreement of both parties.
• 100 PLN / PC. INCLUDES: commercial loans for photo sessions in online and print press; photo sessions not covered by the author's signature; borrowings used as occasional garment set up, for example, at a party, in a television program, used as a stylization, etc. And other loans determined on the basis of the agreement of both parties.
• 70% of the value of clothes and accessories. INCLUDES: Commercial lending for advertisements, photo campaigns, for celebrities, for the CD cover, etc. The category includes all projects in which the clothing has an impact on the promotion of another product (ads, product campaigns, celebrity stylisations, hostesses advertising the product) or has an impact on image / promotion of an external project / person, eg promotion of a concert tour, TV program, costume for a movie or music video, etc.
• OTHER, Individual arrangements by mutual agreement.

Final Provisions
• If one or more provisions of the Regulations are ineffective, the remaining provisions remain effective.
• In relation to all agreements and disputes concluded and created on the basis of the Regulations, the provisions of Polish law shall apply.
• All disputes arising as a result of the concluded contract will be settled by the District Court appropriate for the seat of the Lessor.

REGULAMIN WYPOŻYCZENIA
§ 1
Strony umowy i przedmiot działalności
• Inicjatywa marki „Golden Dust”, dająca możliwość wypożyczenia ubrań i dodatków prowadzony jest przez Karolinę Kajcę prowadzącą działalność gospodarczą pod firmą „Golden Dust Karolina Kajca” z siedzibą we Wschowie (67-400) przy ul. Nowy Rynek 2, NIP: 497-005-91-48, zwanego również „Wynajmującym”, druga strona umowy, dokonująca wypożyczenia za pośrednictwem Wynajmującego zwana jest w dalszej części regulaminu „Biorącym w Używanie”- łącznie zwani „Stronami”. Korespondencja z Wynajmującym może odbywać się za pośrednictwem poczty elektronicznej pod adresem golden.dust.karolina.kajca@gmail.com, numerem telefonu: 503093603, stronie na facebooku Karolina Kajca lub Golden Dust oraz pod adresem korespondencyjnym: Karolina Kajca ul. Nowy Rynek 2, 67-400 Wschowa.
• Niniejszy Regulamin może być zmieniony przez Wynajmującego w razie zmiany przedmiotu działalności lub zakresu usług świadczonych w ramach inicjatywy „Golden Dust” i ich cen, zmiany danych Wynajmującego lub niezgodności Regulaminu z przepisami prawa. Zmiana regulaminu nie może pozbawić lub ograniczać praw Użytkownika nabytych na mocy wcześniejszego brzmienia Regulaminu. Strony związane są treścią aktualnej wersji niniejszego Regulaminu, obowiązującej w momencie złożenia zamówienia.
• Celem działania „Golden Dust” jest świadczenie usług polegającym na bezpłatnym lub odpłatnym wypożyczeniu ubrań i dodatków, określonej dalej jako „Towar” lub „Przedmiot Użyczenia”.
• Towar wypożyczony za pośrednictwem Wynajmującego jest nowy lub używany. Wynajmujący zobowiązany jest dostarczyć zamówione rzeczy bez wad.
• Każdy Daaodatek oznaczony jest co do torżsamości za pomocy nazwy opisującej dany produkt.
§ 2
Zasady zawarcia umowy
• Zawarcie umowy wypożyczenia oznacza zaakceptowanie przez Biorącego w Używanie postanowień niniejszego Regulaminu.
• Umową wypożyczenia uważa się za dokonaną w momencie podpisania przez obie strony „Umowy wypożyczenia” wraz z określeniem celu i terminu wypożyczenia wraz ze szczegółowym wyszczególnieniem wszystkich towarów.
• Kwota opłaty za wypożyczenie towaru określana jest na podstawie „Cennika”
• Umowa zawierana jest w języku polskim
§ 3
Stan Techniczny
• Wynajmujący przekazuje do używania Biorącemu w używanie towar w stanie niezniszczonym co Biorący w Używanie stwierdza własnym podpisem.
• Wynajmujący po otrzymaniu Towaru z wypożyczenia w dniu określonym w umowie słownej lub Umowie Wypożyczenia zobowiązuje się do sprawdzenia ich stanu technicznego najpóźniej w ciągu 1 dnia roboczego od daty zwrotu produktu.
• Biorący w używanie zobowiązuje się do Zwrotu to w stanie czystym i nienaruszonym.
§ 4
Zobowiązania Biorącego do Używania
• Biorący do Używania zobowiązuje się do użytkowania Przedmiotu Użyczenia zgodnie z jego przeznaczeniem i jednocześnie ponosi pełną odpowiedzialność za ewentualne zdarzenia wynikłe z jego nieodpowiedniego wykorzystania i wszelkie uszkodzenia.
• Biorący do Używania zobowiązuje się do użytkowania Przedmiotu Użyczenia zgodnie z celem określonym w 1 Umowy Wypożyczenia.
• Biorący do Używania nie bierze odpowiedzialności za ewentualne nie zamieszczenie wypożyczonego towaru w mediach, a jednocześnie ich opisu w tekście.
§ 5
Okres wypożyczenia oraz zasady naliczania opłaty za wypożyczenie
• Przedmiot Użyczenia zostaje wydany Biorącemu w Używanie w dniu podpisania „Umowy Wypożyczenia”.
• Przedmiot Użyczenia zostaje zwrócony Wynajmującemu w ramach terminu określonego w ramach umowy słownej lub zawartej w „Umowie Wypożyczenia”.
• Wysokość opłat za wypożyczenie określa Cennik w § 7.
• Opłaty za wypożyczenie Przedmiotu Użyczenia liczone są za pełen okres wypożyczenia i pobierane z dołu na podstawie wystawionej faktury.
• Wartość faktury określana jest w dniu zwrotu wypożyczenia.
• Biorący w Używanie otrzymuję fakturę za wypożyczony towar najpóźniej w ciągu 7 dni roboczych od daty zwrotu towaru.
• Termin zapłaty za wypożyczenie określa faktura.
• W przypadku niedotrzymania terminu oddania Przedmiotu Użyczenia, Biorący w Używanie zostanie obciążony płatnością za wypożyczone przedmioty stosownie do wartości określonej w § 6, niezależnie od tego czy wypożyczenie było bezpłatne lub odpłatne.
• Wynajmujący zastrzega sobie możliwość pobrania od Używania kaucji odpowiadającej 70% wartości wypożyczonych rzeczy.
• W przypadku niedotrzymania terminu oddania rzeczy, które w czasie przetrzymywania potrzebne były przy innych projektach Biorący w Używanie ponosi koszty odwołanych sesji.
• W przypadku niedotrzymania terminu oddania rzeczy przez Przedmiot Użyczenia, oraz stwarzaniu problemów w tej kwestii Wynajmujący może nie wyrazić zgody na wykorzystanie Towaru wypożyczonego widocznego w materiale zdjęciowym do upubliczniania w mediach.
• Biorący w Używanie zobowiązuje się do zwrotu Towaru na własny koszt.
§ 6
Kary umowne
• Za uszkodzenia wynikłe z nieodpowiedniego korzystania wypożyczonego towaru winę ponosi Biorący do Używania, on także pokrywa wszystkie koszty związane z naprawą Przedmiotu Użyczenia.
• Wynajmujący zastrzega sobie możliwość odmowy przyjęcia towaru w momencie, gdy uszkodzenie jego będą tak znaczne, że jego naprawa stanie się nieopłacalna. W takim przypadku biorący do Używania zobowiązuje się do zapłaty całej wartości Towaru, według cen nie obejmujących rabatów w sklepie Golden Dust (www.golden-dust.com).
• W przypadku przekroczenia terminu zwrotu Towaru, Wynajmujący zastrzega sobie możliwość naliczenia kary w wysokości 70% wartości ceny produktu wypożyczonego według cen nie obejmujących rabatów w sklepie Golden Dust (www.golden-dust.com) , ubrania oraz produkty niedostępne na witrynie sklepu, Wynajmujący zastrzega sobie możliwość naliczenia kary w wysokości 100zł za rzecz, niezależnie od czasu zwłoki w oddaniu.
• Wynajmujący zastrzega sobie możliwość naliczenia kary w wysokości 70% wartości rzeczy, w przypadku jeśli została ona wykorzystana niezgodnie z celem określonym w Umowie Wypożyczenia.
§ 7
Cennik i naliczanie opłat
• Do każdego wypożyczenia wystawiana jest faktura (podatnika zwolnionego z VAT), która zostanie wysłana Biorącemu w Używanie pocztą lub w formie elektronicznej.
• Ceny wypożyczenia ustalane są na podstawie następujących kategorii:
• 0 PLN. OBEJMUJE: wypożyczenia niekomercyjne do sesji zdjęciowych w prasie internetowej i drukowanej: sesje zdjęciowe opatrzone podpisem autora towaru oraz ustalone na podstawie porozumienia obu stron.
• 100PLN/SZT. OBEJMUJE: wypożyczenia komercyjne do sesji zdjęciowych w prasie internetowej i drukowanej; sesje zdjęciowe nieopatrzone podpisem autora towaru; wypożyczenia wykorzystane jako strój okolicznościowy założony np. na przyjęciu, w programie telewizyjnym, wykorzystany jako stylizacja, itp. Oraz inne wypożyczenia ustalone na podstawie porozumienia obu stron.
• 70% wartości ubrań i dodatków. OBEJMUJE: wypożyczenia komercyjne do reklam, kampanii zdjęciowych, dla gwiazd, na okładkę płyty, itp. Kategoria obejmuje wszystkie projekty, w których ubranie ma wpływ na promocję innego produktu(reklamy, kampanie produktowe, stylizacje gwiazd, hostess reklamujących produkt) lub ma wpływ na wizerunek/promocję zewnętrznego projektu/osoby, np. promocja trasy koncertowej, programu telewizyjnego, kostium do filmu lub teledysku, itp.
• INNE, Ustalenia indywidualne za porozumieniem obu stron.

Postanowienia końcowe
• Jeżeli jedno lub więcej postanowień Regulaminu jest nieskuteczne, pozostałe postanowienia zachowują swoją skuteczność.
• W stosunku do wszelakich umów i sporów zawartych i powstałych na gruncie Regulaminu zastosowanie mają przepisy prawa polskiego.
• Wszystkie spory wynikające w drodze zawartej umowy rozstrzygane będą przez Sąd Rejonowy odpowiedni dla siedziby Wynajmującego.
Regulamin jest ogólnie dostępny na stronie sklepu Wynajmującego Golden Dust (www.golden-dust.com) oraz w informacjach na stronie na facebooku, podpisując Umowę Wypożyczenia Biorący w Używanie jednoznacznie podpizuje regulamin z którym wcześniej powinien się zapoznać.
§ 1

Korespondencja z Wynajmującym może odbywać się za pośrednictwem poczty elektronicznej pod adresem golden.dust.karolina.kajca@gmail.com, numerem telefonu: 503093603, stronie na facebooku Karolina Kajca lub Golden Dust oraz pod adresem korespondencyjnym: Karolina Kajca ul. • Niniejszy Regulamin może być zmieniony przez Wynajmującego w razie zmiany przedmiotu działalności lub zakresu usług świadczonych w ramach inicjatywy „Golden Dust” i ich cen, zmiany danych Wynajmującego lub niezgodności Regulaminu z przepisami prawa. Zmiana regulaminu nie może pozbawić lub ograniczać praw Użytkownika nabytych na mocy wcześniejszego brzmienia Regulaminu. Strony związane są treścią aktualnej wersji niniejszego Regulaminu, obowiązującej w momencie złożenia zamówienia.
• Celem działania „Golden Dust” jest świadczenie usług polegającym na bezpłatnym lub odpłatnym wypożyczeniu ubrań i dodatków, określonej dalej jako „Towar” lub „Przedmiot Użyczenia”.
• Towar wypożyczony za pośrednictwem Wynajmującego jest nowy lub używany. Wynajmujący zobowiązany jest dostarczyć zamówione rzeczy bez wad.
• Każdy Daaodatek oznaczony jest co do torżsamości za pomocy nazwy opisującej dany produkt.
§ 2
Zasady zawarcia umowy
• Zawarcie umowy wypożyczenia oznacza zaakceptowanie przez Biorącego w Używanie postanowień niniejszego Regulaminu.
• Umową wypożyczenia uważa się za dokonaną w momencie podpisania przez obie strony „Umowy wypożyczenia” wraz z określeniem celu i terminu wypożyczenia wraz ze szczegółowym wyszczególnieniem wszystkich towarów.
• Kwota opłaty za wypożyczenie towaru określana jest na podstawie „Cennika”
• Umowa zawierana jest w języku polskim
§ 3
Stan Techniczny
• Wynajmujący przekazuje do używania Biorącemu w używanie towar w stanie niezniszczonym co Biorący w Używanie stwierdza własnym podpisem.
• Wynajmujący po otrzymaniu Towaru z wypożyczenia w dniu określonym w umowie słownej lub Umowie Wypożyczenia zobowiązuje się do sprawdzenia ich stanu technicznego najpóźniej w ciągu 1 dnia roboczego od daty zwrotu produktu.
• Biorący w używanie zobowiązuje się do Zwrotu to w stanie czystym i nienaruszonym.
§ 4
Zobowiązania Biorącego do Używania
• Biorący do Używania zobowiązuje się do użytkowania Przedmiotu Użyczenia zgodnie z jego przeznaczeniem i jednocześnie ponosi pełną odpowiedzialność za ewentualne zdarzenia wynikłe z jego nieodpowiedniego wykorzystania i wszelkie uszkodzenia.
• Biorący do Używania zobowiązuje się do użytkowania Przedmiotu Użyczenia zgodnie z celem określonym w 1 Umowy Wypożyczenia.
• Biorący do Używania nie bierze odpowiedzialności za ewentualne nie zamieszczenie wypożyczonego towaru w mediach, a jednocześnie ich opisu w tekście.
§ 5
Okres wypożyczenia oraz zasady naliczania opłaty za wypożyczenie
• Przedmiot Użyczenia zostaje wydany Biorącemu w Używanie w dniu podpisania „Umowy Wypożyczenia”.
• Przedmiot Użyczenia zostaje zwrócony Wynajmującemu w ramach terminu określonego w ramach umowy słownej lub zawartej w „Umowie Wypożyczenia”.
• Wysokość opłat za wypożyczenie określa Cennik w § 7.
• Opłaty za wypożyczenie Przedmiotu Użyczenia liczone są za pełen okres wypożyczenia i pobierane z dołu na podstawie wystawionej faktury.
• Wartość faktury określana jest w dniu zwrotu wypożyczenia.
• Biorący w Używanie otrzymuję fakturę za wypożyczony towar najpóźniej w ciągu 7 dni roboczych od daty zwrotu towaru.
• Termin zapłaty za wypożyczenie określa faktura.
• W przypadku niedotrzymania terminu oddania Przedmiotu Użyczenia, Biorący w Używanie zostanie obciążony płatnością za wypożyczone przedmioty stosownie do wartości określonej w § 6, niezależnie od tego czy wypożyczenie było bezpłatne lub odpłatne.
• Wynajmujący zastrzega sobie możliwość pobrania od Używania kaucji odpowiadającej 70% wartości wypożyczonych rzeczy.
• W przypadku niedotrzymania terminu oddania rzeczy, które w czasie przetrzymywania potrzebne były przy innych projektach Biorący w Używanie ponosi koszty odwołanych sesji.
• W przypadku niedotrzymania terminu oddania rzeczy przez Przedmiot Użyczenia, oraz stwarzaniu problemów w tej kwestii Wynajmujący może nie wyrazić zgody na wykorzystanie Towaru wypożyczonego widocznego w materiale zdjęciowym do upubliczniania w mediach.
• Biorący w Używanie zobowiązuje się do zwrotu Towaru na własny koszt.
§ 6
Kary umowne
• Za uszkodzenia wynikłe z nieodpowiedniego korzystania wypożyczonego towaru winę ponosi Biorący do Używania, on także pokrywa wszystkie koszty związane z naprawą Przedmiotu Użyczenia.
• Wynajmujący zastrzega sobie możliwość odmowy przyjęcia towaru w momencie, gdy uszkodzenie jego będą tak znaczne, że jego naprawa stanie się nieopłacalna. W takim przypadku biorący do Używania zobowiązuje się do zapłaty całej wartości Towaru, według cen nie obejmujących rabatów w sklepie Golden Dust (www.golden-dust.com).
• W przypadku przekroczenia terminu zwrotu Towaru, Wynajmujący zastrzega sobie możliwość naliczenia kary w wysokości 70% wartości ceny produktu wypożyczonego według cen nie obejmujących rabatów w sklepie Golden Dust (www.golden-dust.com) , ubrania oraz produkty niedostępne na witrynie sklepu, Wynajmujący zastrzega sobie możliwość naliczenia kary w wysokości 100zł za rzecz, niezależnie od czasu zwłoki w oddaniu.
• Wynajmujący zastrzega sobie możliwość naliczenia kary w wysokości 70% wartości rzeczy, w przypadku jeśli została ona wykorzystana niezgodnie z celem określonym w Umowie Wypożyczenia.
§ 7
Cennik i naliczanie opłat
• Do każdego wypożyczenia wystawiana jest faktura (podatnika zwolnionego z VAT), która zostanie wysłana Biorącemu w Używanie pocztą lub w formie elektronicznej.
• Ceny wypożyczenia ustalane są na podstawie następujących kategorii:
• 0 PLN. OBEJMUJE: wypożyczenia niekomercyjne do sesji zdjęciowych w prasie internetowej i drukowanej: sesje zdjęciowe opatrzone podpisem autora towaru oraz ustalone na podstawie porozumienia obu stron.
• 100PLN/SZT. OBEJMUJE: wypożyczenia komercyjne do sesji zdjęciowych w prasie internetowej i drukowanej; sesje zdjęciowe nieopatrzone podpisem autora towaru; wypożyczenia wykorzystane jako strój okolicznościowy założony np. na przyjęciu, w programie telewizyjnym, wykorzystany jako stylizacja, itp. Oraz inne wypożyczenia ustalone na podstawie porozumienia obu stron.
• 70% wartości ubrań i dodatków. OBEJMUJE: wypożyczenia komercyjne do reklam, kampanii zdjęciowych, dla gwiazd, na okładkę płyty, itp. Kategoria obejmuje wszystkie projekty, w których ubranie ma wpływ na promocję innego produktu(reklamy, kampanie produktowe, stylizacje gwiazd, hostess reklamujących produkt) lub ma wpływ na wizerunek/promocję zewnętrznego projektu/osoby, np. promocja trasy koncertowej, programu telewizyjnego, kostium do filmu lub teledysku, itp.
• INNE, Ustalenia indywidualne za porozumieniem obu stron.

Postanowienia końcowe
• Jeżeli jedno lub więcej postanowień Regulaminu jest nieskuteczne, pozostałe postanowienia zachowują swoją skuteczność.
• W stosunku do wszelakich umów i sporów zawartych i powstałych na gruncie Regulaminu zastosowanie mają przepisy prawa polskiego.
• Wszystkie spory wynikające w drodze zawartej umowy rozstrzygane będą przez Sąd Rejonowy odpowiedni dla siedziby Wynajmującego.
Regulamin jest ogólnie dostępny na stronie sklepu Wynajmującego Golden Dust (www.golden-dust.com) oraz w informacjach na stronie na facebooku, podpisując Umowę Wypożyczenia Biorący w Używanie jednoznacznie podpizuje regulamin z którym wcześniej powinien się zapoznać.
